Terms of Use, Privacy Policy, and Disclaimer

Privacy Policy

Effective date: August 12, 2025
Legal entity: The Murphy Group Advisors, LLC (“TMG,” “we,” “us,” “our”)
Website: TheMGRealtors.com and connected landing pages, forms, and microsites (collectively, the “Site”)

1) Scope & Who This Covers

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our Site, contact us, engage with our ads, submit forms, call or text us, use our social pages, or otherwise interact with The Murphy Group. It also describes your choices and rights. This Policy applies to consumers, clients, prospects, vendors, and job applicants. Certain state-specific notices (e.g., California, Virginia, Colorado) appear in Section 14.

2) Categories of Personal Information We Collect

  • Identifiers & contact data: name, email, phone, postal address, government ID (if you provide it for a transaction), IP address, device identifiers.

  • Commercial info: property interests, saved homes, inquiries, tours, offers, transactions, closing documents, preferences.

  • Protected classification info (optional/only if provided): e.g., veteran status where permitted by law (we do not collect sensitive data unless you choose to submit it).

  • Internet / device data: pages viewed, links clicked, session duration, referrer, approximate geolocation, cookie IDs, pixels.

  • Inferences: likely interest in buying/selling/renting, investor profile, service preferences.

  • Professional info: employer, title (when relevant to commercial deals), licensing docs provided by vendors/agents.

  • Communications: emails, SMS/MMS, call metadata, call recordings/voicemails (see Section 10).

  • Financial docs for rentals/transactions (only as required): income, employment verification, bank letters, application data, screening outcomes from third-party screeners you authorize.

Sources include: information you submit; lead providers and advertising platforms; social media you connect; analytics/advertising technologies (cookies, pixels, SDKs); and public records (auditor/MLS) used for real estate due diligence.

3) Why We Use Your Information (Purposes)

  • Provide brokerage, advisory, and property management services; schedule showings; prepare offers and listing agreements; coordinate vendors and title/escrow.

  • Lead management and follow-up (calls, emails, texts) you request or reasonably expect from an inquiry.

  • Marketing and remarketing (including “targeted advertising”/“cross-context behavioral advertising” as defined by certain state laws) with opt-out choices (Section 8 & Section 14).

  • Compliance with law (recordkeeping, fair housing, tax, anti-fraud); security and anti-spam; quality assurance (call monitoring); defending legal claims.

  • With your consent for additional uses where required (e.g., certain SMS programs, some cookies in EU/UK).

GDPR legal bases (for EU/UK visitors): consent; contract performance; legitimate interests (brokerage operations, analytics, security); legal obligations. (GDPR, dataprotection.ie)

4) Cookies, Pixels, and Analytics

We and our partners use cookies/pixels to remember settings, measure traffic and conversions, and run retargeting. You can manage cookies via your browser and (where offered) our cookie banner. Some states recognize browser-level universal opt-out signals—we honor recognized signals for covered users (see Section 14). (Colorado Attorney General, Duane Morris)

5) Email Marketing (CAN-SPAM)

If you opt into marketing email, we send occasional updates (listings, market news, events). Every marketing email includes our business address and a working unsubscribe link, and we honor opt-out requests promptly. We do not use deceptive headers or subject lines. (Federal Trade Commission, Federal Communications Commission)

6) Text Messaging & Autodialed Outreach (TCPA/CTIA)

  • Consent & scope. When you submit your phone number, you agree that TMG (and our agents) may contact you by call or text about real estate services. Certain calls/texts, including those made with an autodialer or containing marketing content, require your prior express written consent under the Telephone Consumer Protection Act (TCPA); we collect and store consent logs. You can revoke consent at any time by replying STOP to any text or contacting us (Section 16). (Legal Information Institute, Federal Communications Commission)

  • CTIA/Carrier rules. Our SMS programs follow CTIA Messaging Principles and short-code/10DLC best practices: clear opt-in, message frequency, HELP and STOP keywords, identification of sender, and disclosure of message/data rates. Carrier filtering is possible if best practices are not followed. (CTIA API, CTIA)

  • Do Not Call & TSR. We scrub telemarketing calls against the National Do Not Call Registry and maintain internal do-not-call lists per the FTC’s Telemarketing Sales Rule. We avoid abandoned calls and comply with calling hour limits. (Federal Trade Commission)

TCPA Consent Language You’ll See on Our Forms

“By clicking Submit, you agree The Murphy Group, LLC may contact you at the number and email provided (including by autodialed and prerecorded calls or text/SMS) about your inquiry and related real estate services. Message/data rates may apply. Consent is not required to buy or sell real estate. You can reply STOP to cancel and HELP for help. See our Privacy Policy.”
This language appears adjacent to the submit button (or checkbox) and records timestamp, source page, and IP for compliance. (Federal Communications Commission)

7) “Selling” or “Sharing” and Targeted Advertising

We do not sell personal information for money. Some states define “sell” or “share” broadly to include disclosure for cross-context behavioral advertising (retargeting). Where that definition applies, we treat such activity as a “sale” or “sharing” and offer opt-out mechanisms, including honoring recognized universal opt-out signals (Section 14). (California DOJ, California Privacy Protection Agency, Duane Morris)

8) Your Privacy Choices

  • Opt out of emails: use the unsubscribe link.

  • Opt out of texts: reply STOP.

  • Do Not Call: ask us to place you on our internal DNC list.

  • Targeted ads: use our cookie banner, the Global Privacy Control (GPC) or similar browser signals where recognized, or contact us. (Colorado Attorney General)

9) How We Share Information

We share data with service providers under contracts that limit use to our instructions—examples: website hosting, CRM, analytics, ad platforms, email/SMS providers, screening vendors (when you apply), title/escrow/loan officers you direct us to, and professional advisers. We may disclose information as required by law, to protect rights/safety, in business transfers, or with your direction/consent.

10) Call Recording & Ohio Law

We may record client service calls for quality and compliance. Ohio is a one-party consent state; if we are a participant, we may lawfully record. We provide in-call or IVR disclosure where required by other jurisdictions. If you prefer not to be recorded, tell the agent and we will not proceed with recording or will switch to an unrecorded channel. (Ohio State Bar Association, Moermond & Mulligan, LLC)

11) Data Retention

We keep transaction records consistent with broker recordkeeping rules, tax/audit obligations, and litigation holds. Marketing leads are retained while actively engaged and then minimized or deleted per our retention schedule. We maintain suppression lists to honor opt-out requests indefinitely.

12) Security

We apply administrative, technical, and physical safeguards appropriate to the sensitivity of the data (access controls, encryption in transit, least-privilege access, vendor due diligence). No system is perfect; we cannot guarantee absolute security.

13) Children’s Privacy

Our services are not directed to children under 13, and we do not knowingly collect their data. If we learn we collected data from a child under 13 without parental consent, we will delete it. For more information see FTC COPPA guidance and rule. (Federal Trade Commission)

14) State & Regional Notices

California (CCPA/CPRA)

If you are a California resident, you have the rights to know/access, delete, correct, and opt-out of sale/share, and to limit certain uses of sensitive data. We honor GPC or similar opt-out preference signals for sale/share. Non-discrimination applies for exercising rights. Submit requests as described in Section 16. (California DOJ, California Privacy Protection Agency)

Virginia (VCDPA)

Virginia residents can request access, correction, deletion, portability, and opt-out of targeted advertising, sale, and certain profiling. If we deny your request, an appeals process is available (see Section 16). (Virginia Law, Termly)

Colorado (CPA)

Colorado residents have similar rights (access, correction, deletion, portability, opt-out of targeted advertising/sale/profiling). We must recognize Colorado’s public list of Universal Opt-Out Mechanisms (UOOM). (Colorado Attorney General, Duane Morris)

Other U.S. State Laws

A growing number of states (e.g., CT, UT, OR, TX, MT, DE, IA, IN, TN) have privacy laws with similar rights and definitions, though thresholds and details vary. We apply a consistent, rights-respecting process; when you submit a verified rights request and identify your state of residence, we apply the appropriate standards.

Ohio

Ohio does not yet have a comprehensive general consumer privacy statute in effect as of the effective date above (several bills have been introduced), but Ohio law includes other relevant provisions (e.g., call recording is one-party consent; unfair/deceptive practices). We monitor developments and will update this Policy if a new Ohio privacy law becomes applicable. (DataGuidance, Ohio Legislature)

15) International Visitors & Data Transfers

If you access our Site from the EU/UK, we rely on GDPR legal bases noted in Section 3 and may transfer data to U.S. service providers using the EU-U.S. Data Privacy Framework, Standard Contractual Clauses, or other recognized transfer tools. (Axios)

16) Exercising Your Rights; Opt-Outs; Appeals; Authorized Agents

Submit requests to: Team@TheMGRealtors.com.
Provide sufficient information to verify your identity (and authority if acting as an agent) and describe your request. We will respond within the time required by applicable law.

  • Opt-out of sale/share/targeted ads: use the Site’s “Do Not Sell or Share My Personal Information” link (where required) and/or your browser’s supported UOOM/GPC signal. (Colorado Attorney General)

  • Opt-out of emails: click unsubscribe.

  • Opt-out of texts: reply STOP.

  • Appeals (where required, e.g., VA/CO/CT): If we deny your request, you may appeal by replying to our decision email with “Appeal.” If still unresolved, you may contact your state attorney general.

17) Lead Sources & Data Brokers

We may obtain leads from advertising platforms and reputable data partners. We require them to provide appropriate notices and honor opt-out signals. California residents may have additional rights to learn about data brokers and use the Delete Act/DROP process as it becomes available statewide. (WIRED)

18) Do Not Track & Global Signals

Our Site currently responds to legally recognized universal opt-out signals (e.g., Colorado UOOM) and GPC for covered jurisdictions. Where not required, you can still manage cookies in your browser. (Colorado Attorney General)

19) Third-Party Links & Sites

Our Site may link to third-party sites (e.g., lender/title partners, screening services). Their privacy practices are governed by their own policies.

20) Data Minimization

We collect only what we need for the purposes described (Section 3) and retain it for no longer than necessary or legally required.

21) Changes to This Policy

We may update this Policy to reflect operational or legal changes. We will post the “Effective date” and, for material changes, provide additional notice (banner or email, where feasible).
